Government Gazettes Bill to Strengthen Response to Illegal Land Occupations

Show Voice Options Government has published the Prevention of Illegal Eviction from and Unlawful Occupation of Land (PIE) Amendment Bill in the Government Gazette as part of efforts to respond more decisively to illegal land occupations and unlawful building invasions across South Africa. Human Settlements Minister Thembi Simelane said the proposed amendments aim to strengthen the 1998 PIE Act by making it easier to interpret, faster to enforce, and more effective in protecting both vulnerable communities and lawful property rights. The bill introduces tougher measures against individuals and organised groups that incite or coordinate illegal land occupations, including fines of up to R2 million or imprisonment of up to two years, as well as possible forfeiture of assets gained through unlawful land sales. It also seeks to improve court processes, require stronger municipal involvement, and reduce the lengthy legal delays that often increase costs for government and private landowners. With unlawful occupations placing major financial and administrative pressure on municipalities and disrupting planned housing and infrastructure development, government says the new legislation is intended to balance social justice with the rule of law while protecting communities from exploitation by criminal syndicates operating behind illegal land invasions. Public comments on the bill have been opened for 60 days before it returns to Cabinet and later Parliament for further consideration.
